Obama Administration Releases 2013 Joint Strategic Plan on Intellectual Property Enforcement

On June 20, 2013, U.S. Intellectual Property Enforcement Coordinator Victoria A. Espinel published the second Joint Strategic Plan on Intellectual Property Enforcement (Joint Strategic Plan).  The Joint Strategic Plan outlines the activities of the Office of the U.S. Intellectual Property Enforcement Coordinator over the next three years and also details the progress made since the first Joint Strategic Plan was issued in June 2010.

As proof of the progress made in the three years since the first Joint Strategic Plan, Espinel cited improved coordination and efficiency of the Federal agencies, significant increase in U.S. law enforcement operations, voluntary initiatives in the private sector targeting online infringement, increased focus on trade secret theft and economic espionage, and advances in cooperation and coordination with our trading partners in enforcement.  The bulk of the Join Strategic Plan, however, focuses on what remains to be done over the next three years.

The Joint Strategic Plan contains 26 action items grouped under 6 categories: leading by example, transparency and public outreach, ensuring efficiency and coordination, enforcing our rights abroad, securing the supply chain, and data-driven government.  The Joint Strategic Plan also specifically mentions a few areas of particular concern going forward, including abusive patent litigation tactics by patent trolls, forced technology transfers in global trade, increased use of smartphones and mobile apps, and the development of 3D printing.

Espinel also notes two areas in which the Office of the U.S. Intellectual Property Enforcement Coordinator seeks public input.  First, it seeks opinions on improving the enforcement of patents at the border.  Second, through the U.S. Patent and Trademark Office, views are being solicited on the effectiveness of the voluntary initiatives that have been encouraged to reduce online infringement.
